Individuals: Planning Case Study

We are representing an individual whose family home was impacted by a new dwelling overlooking his garden. We advised that because it was not built in accordance with the approved plans it did not have planning permission. At first the local planning authority refused to acknowledge that the new dwelling had been built in the wrong location but following pressure from us the Council acknowledged that the dwelling was in the wrong place. After that there have been a number of unsuccessful applications for retrospective planning permission by the developer but the Council has now started enforcement proceedings to remove the unlawful dwelling.
